VAT REFUND

To be able to refund VAT the applicant must be a taxable person, established in the EU, performing taxable supplies in a member country. The taxable person must have accrued VAT over the expenses made in a member country. VAT refund should be associated with economic activity that is made out of the country member that refunds VAT.

MINIMAL REFUND AMOUNT 

- 400 euro or the equivalent in national currency if the refund period is between 3 months and 1year.

- 50 euro or the equivalent in national currency if the period is one year or the rest of the calendar year.

TERMS 

The refund request submits in the country member of establishment until 30 September of the calendar year following the period of refund.  

TERMS OF PROCESSING THE VAT REFUND REQUEST

The country member that refunds VAT has 4 months to inform the applicant- to accept, reject or ask for more information. If there is more information needed the terms for taking a decision are being extended with two more months from the date  the refund  request is received.

  • the company depends on the capacity of the person
  • self – financing
  • hard to attract foreign investments
  • can not be transformed

JOINT-STOCK COMPANY

Advantages

  • limited responsibility (to the share)
  • easy to gather capital through issuance of shares
  • easy to transfer shares between shareholders

Disadvantages

  • capital required for registration – 50 000 BGN
  • required publicity
  • double taxation
  • lack of relation between the Joint –stock company and the shareholders
  • different interest between shareholders and joint – stock company manage

LIMITED LIABILITY COMPANY

Advantages

  • limited responsibility to the size of the formed capital
  • minimal amount of share capital that needs registration
  • easy to attract foreign investments
  • distribution of work between partners
  • distribution of loss between partners
  • taking better decisions together with partners

Disadvantages

  • higher public charges for registration
  • responsibility for publishing annual tax declarations into commercial register
